[2025.09.16] Notice of Updates to Terms of Service and Privacy Policy (September 25, 2025)

Thank you for always using the Opensurvey service.

Please note that our Terms of Service and Privacy Policy will be updated as follows.

1. Effective Date

2. Purpose and Details of the Changes

[Terms of Service]

  • The Professional Plan of the “Dataspace Service” can now be subscribed to by online card payment, and additional “Credits” and “Seats” may also be purchased by online card payment while using any paid plan. Accordingly, we have added the necessary provisions to the Terms of Service.

Section 1 (Definitions)

  • 9. “Fees”: All charges billed to the Member for the use of the Service, as set forth on the Pricing Page(https://opensurvey.io/pricing) or otherwise notified to the Member by the Company.

  • 13. “Order Form”: The purchase record specifying the Service subscribed to by the Member and the corresponding Fees.

  • 14. “Subscription”: The right, in consideration of payment by the Member, to use the Dataspace Service and its features during the period specified in the Order Form, on a non-exclusive and non-transferable basis.

  • 15. “Subscription Term”: The period from the date on which the Fees are paid until the day before the next billing date, according to the billing cycle (monthly, annually, etc.) selected by the Member in the Order Form for the Dataspace Service.

  • 16. “Auto-Renewal Payment”: The automatic renewal of a Subscription through the same payment method, when a Member pays for the Professional Plan of the Dataspace Service by online card payment and the Subscription Term expires.

  • 17. “Seat”: An individual user license that grants access to a specific Space within the Dataspace Service. A Member may invite other users to a Space up to the number of Seats purchased.

  • 18. “Credit”: A prepaid unit that is deducted when using features of the Dataspace Service such as survey distribution, response collection, data import, or text analytics.

Section 9 (Use of Paid Services)

  • 13. The “Credits” granted as part of a “Subscription” to the “Dataspace Service” (“Base Credits”) may only be used during the applicable “Subscription Term,” and any unused “Credits” will expire at the end of the “Subscription Term.”

  • 14. If a “Member” requires additional “Credits” during the “Subscription Term,” the “Member” may purchase them by paying the applicable “Fees.” Additional “Credits” are valid for one (1) year from the date of purchase, after which any unused “Credits” will expire and are non-refundable.

  • 15. When a “Member” subscribes to the Professional Plan of the “Dataspace Service” by paying the “Fees” through online card payment, the following shall apply:

    • “Auto-Renewal Payment” will apply in accordance with the billing cycle (monthly or annual) specified in the “Order Form” completed by the “Member” for the “Subscription.”

    • A “Member” may cancel or withdraw the auto-renewal of the next “Subscription” at any time during the current “Subscription Term” through the account settings page. Unless canceled, the “Subscription” will automatically renew under the same terms.

    • If auto-renewal is canceled, the “Member” may continue to use the “Service” during the remaining “Subscription Term,” but the next “Subscription” will not renew and “Auto-Renewal Payment” will cease.

    • Any unused “Base Credits” at the time of auto-renewal will not carry over and will automatically expire, and new “Base Credits” will be granted for the renewed “Subscription.”

    • If additional “Seats” are required during the “Subscription Term,” they may be purchased by online card payment, and any “Seats” so purchased will be included in the “Fees” and charged through “Auto-Renewal Payment” upon the renewal of the next “Subscription.”

    • If the Professional Plan is subscribed through a payment method other than online card payment (e.g., bank transfer, tax invoice) or if any other paid plan is subscribed, the provisions of this Section shall not apply.

  • We have specified in the Terms of Service the existing operational policy for “Credits” included in the “Free Services,” in order to provide greater transparency to our members.

Section 10 (Use of Free Service)

  • 2. Credits granted as part of the Free Services may only be used while the Member is using the Free Services. Any unused Credits will not carry over and will expire upon the Member’s transition to a Paid Service.

6. Delegation of Personal Information Processing

    • Purpose of disclosure : Provision of subscription-based payment and settlement services

    • Recipient country : United Kingdom

    • Transfer method and time : Transmission over the network at the time of service use

    • Transferred personal information : Personal information (email) collected during payment processing and subscription management

    • Personal information usage and retention period:

      • Customer-related information is, in principle, retained for at least 10 years in accordance with Paddle’s internal Data Retention Policy.

      • Certain items such as payment and subscription history are retained for 10 years to comply with legal and regulatory requirements and for legitimate business interests.

      • Even after membership withdrawal or termination of the contract, data may be retained for a certain period in accordance with Paddle’s internal policies and legal obligations.

3. Objections and Inquiries

If you have any questions regarding these changes to the Terms of Service and the Privacy Policy, please contact the Opensurvey Help Center.

If you do not agree with the revised Terms of Service and Privacy Policy, you may request to withdraw your membership. If no objections are raised by the effective date, it will be considered that you have agreed to the changes.
